Privacy Policy

This Privacy Policy (the “Policy”) describes how MustExist, Inc. d/b/a ConvoScience (“ConvoScience,” “we,” “us,” or “our”) collects, uses, discloses, and protects information in connection with our website at www.convoscience.com (the “Site”) and the services, software, products, deliverables, and related offerings we provide to our business customers (collectively, the “Offering”). Capitalized terms not defined in this Policy have the meanings given in our Terms and Conditions.

1. Scope; Our Role

This Policy applies to information we collect about:

  1. (a)visitors to the Site, including individuals who request a call or otherwise contact us;
  2. (b)representatives of our current and prospective customers, including owners, managers, and agents who use the Offering ("Authorized Users"); and
  3. (c)individuals whose information is contained in Customer Data, such as callers to a Customer's business, to the extent described in Section 4.

ConvoScience provides the Offering to businesses (each, a “Customer”). When we process Customer Data, including call recordings, we do so on behalf of and at the direction of the Customer under our Agreement with that Customer. In that role, we act as a “service provider” or “processor” under applicable privacy laws, and the Customer is responsible for its own privacy practices.

If you called a business that uses ConvoScience and have questions about a recording of your call, please contact that business directly. It controls how your information is used, and we will assist it in responding to your request as required by law.

2. Information We Collect

We collect the following categories of information:

  1. (a)Information you provide to us, such as your name, email address, phone number, company name, job title, and the content of messages you send when you book a call, contact us, or communicate with us;
  2. (b)Account information for Authorized Users, such as name, business email address, role, login credentials, and settings or preferences within the Offering;
  3. (c)Customer Data that a Customer provides to us or that the Offering accesses from the Customer's systems, networks, or third-party services, including call recordings, transcripts, call metadata (such as date, time, duration, and phone numbers), and information about the Customer's agents and callers, as further described in Section 4;
  4. (d)Usage information about how Authorized Users interact with the Offering, such as features used, pages viewed, and actions taken; and
  5. (e)Device and technical information collected automatically when you visit the Site or use the Offering, such as IP address, browser type, operating system, referring URLs, and dates and times of access.

3. How We Use Information

We use the information we collect to:

  1. (a)provide, operate, maintain, and support the Offering;
  2. (b)respond to inquiries, schedule calls, and communicate with current and prospective customers;
  3. (c)send administrative and service-related communications, such as account notices, security alerts, and updates to our terms or policies;
  4. (d)send marketing communications about ConvoScience, where permitted by applicable law, subject to your right to opt out;
  5. (e)monitor, secure, and protect the Site and the Offering, and detect and prevent fraud, abuse, and security incidents;
  6. (f)analyze usage and improve the Site and the Offering; and
  7. (g)comply with applicable law, enforce our agreements, and protect the rights, property, and safety of ConvoScience, our customers, and others.

4. Customer Data; Call Recordings

The Offering analyzes call recordings and related information that Customers make available to us, for example by connecting the Offering to their telephony systems. As set forth in our Agreement with each Customer, ConvoScience uses Customer Data only as necessary to provide, maintain, secure, support, and improve the Offering, to comply with applicable law, and as otherwise permitted by the Agreement.

We do not sell Customer Data. We may create aggregated or de-identified information derived from Customer Data, such as general patterns in what makes sales calls successful, and use it to improve the Offering and to describe our results. Aggregated or de-identified information does not identify any Customer, agent, or caller, and we will not attempt to re-identify it.

We use third-party artificial intelligence and machine learning service providers to help analyze Customer Data. We do not permit these providers to use Customer Data to train, retrain, or improve their own models, and they may process Customer Data only as necessary to provide their services to ConvoScience.

Each Customer is responsible for providing any notices and obtaining any consents required by applicable law for the recording of calls and for ConvoScience's processing of Customer Data, including under laws that require the consent of all parties to a call.

5. How We Share Information

We may disclose information as follows:

  1. (a)to the applicable Customer and its Authorized Users, who can access Customer Data and related analysis within the Offering;
  2. (b)to service providers and subprocessors that perform services on our behalf, such as cloud hosting, data storage, transcription, artificial intelligence and machine learning processing, analytics, email, and scheduling, subject to confidentiality and data protection obligations;
  3. (c)to comply with applicable law, regulation, legal process, or enforceable governmental request;
  4. (d)to protect the rights, property, or safety of ConvoScience, our customers, or others, including to enforce our agreements;
  5. (e)in connection with a merger, acquisition, corporate reorganization, financing, or sale of all or substantially all of our assets, subject to customary confidentiality protections; and
  6. (f)with your consent or at your direction.

We do not sell personal information, and we do not share personal information for cross-context behavioral advertising.

6. Cookies; Analytics

We and our service providers may use cookies, pixels, and similar technologies on the Site and in the Offering to keep you signed in, remember your preferences, understand how the Site and the Offering are used, and improve them. You can control cookies through your browser settings. If you disable cookies, some features of the Site or the Offering may not function properly.

7. Data Retention

We retain information for as long as reasonably necessary to fulfill the purposes described in this Policy, including to provide the Offering, comply with our legal obligations, resolve disputes, and enforce our agreements. We retain Customer Data in accordance with the applicable Agreement and the Customer's instructions. Upon expiration or termination of an Agreement, we will return or delete Customer Data as provided in that Agreement, except that we may retain copies as required by law or in standard backup systems, which remain subject to this Policy until deleted in the ordinary course.

8. Security

ConvoScience implements and maintains reasonable administrative, physical, and technical safeguards designed to protect information from unauthorized access, use, alteration, or disclosure. No method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. Certain aspects of the Offering may depend on Customer systems, third-party platforms, telecommunications providers, and other services outside of ConvoScience's control.

9. Your Rights; Choices

Depending on where you live, including if you are a California resident, you may have the right to:

  1. (a)request access to, or a copy of, the personal information we hold about you;
  2. (b)request correction of inaccurate personal information;
  3. (c)request deletion of your personal information, subject to exceptions under applicable law;
  4. (d)request information about the categories of personal information we collect, use, and disclose; and
  5. (e)not be discriminated against for exercising any of these rights.

To exercise these rights, please contact us at the email address in Section 13. We may need to verify your identity before responding. You may also designate an authorized agent to make a request on your behalf, subject to verification. If your request relates to Customer Data, such as a recording of a call you made to a business, we will refer your request to the applicable Customer and assist it as required by law.

You may opt out of marketing emails at any time by using the unsubscribe link in those emails or by contacting us. We may still send you administrative and service-related communications.

10. Children's Privacy

The Site and the Offering are intended for businesses and are not directed to children under the age of 16. We do not knowingly collect personal information from children under 16. If you believe a child has provided us with personal information, please contact us and we will take steps to delete it.

11. International Users

ConvoScience is based in the United States, and we process and store information in the United States and in other countries where our service providers operate. If you access the Site or the Offering from outside the United States, you understand that your information will be transferred to, processed, and stored in the United States, where data protection laws may differ from those in your jurisdiction.

12. Changes to This Policy

We may update this Policy from time to time. When we do, we will revise the version date at the top of this page. If we make material changes, we will take reasonable steps to notify Customers, such as by email or through the Offering. Your continued use of the Site or the Offering after an update takes effect constitutes your acknowledgment of the updated Policy.
